Subpoenas and other legal documents

The following information is provided as a courtesy for purposes of identifying registered agents available for service of legal process upon Synchrony Bank (“SYB”). It also sets forth ways SYB could be personally served a subpoena when a registered agent is not available. Please note that this list is subject to change without notice. By providing this list, SYB and its affiliates do not waive any rights including, without limitation, the right to object to service of process on any basis including but not limited to any and all objections arising out of defective or improper service.

Service of subpoenas in civil cases

SYB is committed to protecting the privacy of its customers. Consistent with the requirements of applicable consumer protection laws, including the Gramm Leach Bliley Act and the Right to Financial Privacy Act, SYB will only produce customer records in a civil case in response to a validly issued and served subpoena, under applicable law, or with express consent from the customer whose documents are being requested.

To effect service on SYB, you should obtain a subpoena issued by a federal court (if applicable) or, as applicable, domesticated in state court in Utah, where SYB is chartered. The address for personal service is:

Note: Service of a subpoena through your Secretary of State or another registered agent (excluding CT Corporation in CA,DE, MA, OH, and PR) is not proper service on SYB. For cases in state court, please note that for a subpoena to be fulfilled, the subpoena must be served personally at the addresses provided above, domesticated in Utah or a release obtained from the account holder.

Subpoenas and other legal information requests should:

• Be specific with respect to what is being requested. Requests seeking “any and all” documents may require clarification and/or additional time to process.
• Identify the court/jurisdiction, case number, and contact information of the requestor.
• Identify specific date range request.
• Be signed and dated by the proper court and/or officer of the court.
• Include adequate information to identify responsive documents (e.g., full account numbers, SSN, name & DOB).

Fees - We reserve the right to charge reasonable administrative fees and costs (unless otherwise prohibited by law) for producing documents, providing affidavits, and/or responding to any subpoena or other legal information requests.

Civil subpoena status inquiries

SYB works diligently to ensure that properly issued and served subpoenas are fulfilled within a reasonable time. In limited occasions, depending on the complexity of your requests, our responses may take 30-60 days from date of receipt of the subpoena. In rare occasions, due to vague or incomplete requests, the subpoenaed account records cannot be located. In those rare instances, the request will be rejected until you provide information to enable SYB to locate the records.
